Westsyde farmers out of luck getting ALR exemption

NEWS/ CITY — A Kamloops farmer and City council candidate is one of two Westsyde property owners out of luck in getting non-farm use for their Dairy Road properties.

Dieter Dudy’s application to the Agricultural Land Commission to allow non-farm uses was not allowed by the ALC, nor was that of his neighbours Leopold Lindinger and Patricia Sullivan.

Their non-farm uses included such things as catered events on the farm properties. There were neighbour complaints about events at both farms.

City development services director Marvin Kwiatkowski said the ALC was concerned about impacts on neighbouring properties if the non-farm uses were allowed.

While the applicants can’t move ahead with municipal permits because of the ALC’s decisions, City staff will follow up to work through outstanding issues with the farmers and the commission, he said.

Mayor Peter Milobar pointed out that if the farmers want to appeal, they have to do that directly to the ALC. It’s not up to the City to file an appeal on their behalf.

    Absolutely insane to restrict use for events such as the Kamloops Symphony and other good causes through catered events. If there were any impacts they were minimal. It’s not as if there were events every weekend or every day of the week. And, as I understand it neighbours were invited to Dieter’s events and if there was any damage to fences etc Dieter certainly would have made the repairs with apology. As well there was no loud music and all attendees respected parking concerns. Could this just be a matter of jealously and personality conflicts with neighbours and thus has absolutely nothing to do with events? Quite a loss to many who attended these functions.

  2. This is too bad. It is crazy to me that farmers can be restricted from having early evening outdoor events, but it is okay to do resource development on ALR land. What double standards!

    • Exactly! Dieter – you should put in an application to hold a Frack Fest in your most productive field and see how quickly the permit comes through.
